SMS / Text Messaging Terms

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode or sending number. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you. If you experience issues with the messaging program, reply with the keyword HELP for more assistance.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

This campaign sends appointment information, service updates, confirmation & reminder messages to customers once they have booked an appointment or registered with Pixel Spark LLC / Snowball Reviews on the website form and opted-in to receive SMS communications.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Account means a unique account created for You to access our Service or parts of our Service.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service. You represent that you are over the age of 18.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company.

Purchases, Subscriptions & Payments

Placing Orders

By placing an Order for Services or Subscriptions through the Service, You warrant that You are legally capable of entering into binding contracts and that the payment details provided are accurate and valid.

Subscriptions & Recurring Billing

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of Subscription plan you select.

• Automatic Renewal: At the end of each billing cycle, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.

• Cancellation: You may cancel Your Subscription renewal at any time through Your online account management page or by contacting us at [email protected]. Cancellation will take effect at the end of the current paid billing cycle, and you will retain access to the Service until that date.

Payments & Processing

Payment can be made through various payment methods we make available, including credit cards (Visa, MasterCard, American Express, Discover) and online payment systems (such as Stripe or PayPal).

By submitting Your payment details, You authorize our third-party payment processor (Stripe) to charge all fees incurred through Your account. Payment cards are subject to validation checks and authorization by Your card issuer. If we do not receive required authorization, We will not be liable for any suspension, delay, or non-delivery of Services.

Fee Changes

The Company, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current billing cycle. We will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.

Cancellation & Refund Policy

• Digital Services & Retainers: Once agency fulfillment, setup, or onboarding work has begun, setup fees and completed service fees are non-refundable.

• Subscriptions: You may cancel your Subscription at any time. We do not provide prorated refunds for mid-billing cycle cancellations; your access will continue through the end of the already-paid period.

• Exceptions: If you believe you were charged in error, please contact us at [email protected] within 30 days of the charge date to request an investigation and appropriate adjustment.

User Accounts

When You create an account with Us, You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account.

You are responsible for safeguarding the credentials You use to access the Service and for any activities or actions under Your password. You agree not to disclose Your password to any third party and must notify Us immediately upon becoming aware of any unauthorized use of Your account.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Pixel Spark LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You to the Company through the Service in the 12 months preceding the claim, or 100 USD if You haven't made a purchase.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, business interruption, or loss of privacy).

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Governing Law & Dispute Resolution

The laws of the State of Wyoming, United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally and in good faith by contacting the Company directly prior to initiating any chargeback or formal legal proceeding.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Our Service after revisions become effective, You agree to be bound by the revised terms.
